The Matthews Town Board last week deferred until October 8th a vote on a proposal to create a new Zoning Overlay District (SAP-O) that would make the land use and development policies in three Small Area Plans enforceable on all new development, regardless of whether or not a rezoning is involved.

Charlotte Invites Developers to Brainstorming Session this Friday on Expedited Plan Plat Review Program

The City of Charlotte is seeking developer input into the design of its Enhanced Plan Review and the Expedited Plat Review Programs, and has scheduled a Brainstorming session this Friday morning at the Government Center.

City Council recently approved an Enhanced Plan Review Program for Subdivisions, Urbans and an Expedited Program for Plats.  For Subdivision and Urban submittals, the fee would be an additional $30,000 on top of all of the pertinent fees for the project.    For Plats, the fee would be an additional $1,000 on top of all of the pertinent fees for the project.   At this session, City staff is looking for developer input into these questions:

  • For Subdivisions and Urbans, if you were to pay the additional $30,000, what would the Enhanced Review program look like?  (time, which agencies would review, etc)
  • For Plats, if you were to pay the additional $1,000, what would the Expedited Plat Review program look like?

City Planners Release New Draft of TOD Ordinance

The Charlotte Planning Department has released an updated draft of its new Transit-Oriented Development (TOD) ordinance, after hearing concerns from REBIC and other industry groups that the initial proposal was too restrictive. The new draft is still not complete — city planners are still working on additional sections that will be released with later drafts.

The four new proposed TOD districts have been renamed TOD-H1 (High Intensity), TOD-H2 (High Intensity – Transition), TOD-M1 (Moderate Intensity), and TOD-M2 (Moderate Intensity – Transition). Each district is described in greater detail beginning on Page 2 of the draft.

Planners will set up an online Comments form in the next few days where you will be able to provide your feedback on this draft. We’ll add this link to our Blog as soon as it becomes available.

The City is also hosting an information meeting on Transit-Oriented Development next Tuesday, August 14th at 6 p.m.  at the CLT Powerhouse, 1507 Camden Road. This is intended only to provide a general overview of TOD, but will be valuable for developers interested in learning about this land use type.

REBIC members and staff are in the process of reviewing the new draft, which will be discussed later this month at the City’s Ordinance Advisory Committee meeting.

McHenry Speaks in Belmont on Opportunity Zone Program

McHenryEarlier this week, Congressman Patrick McHenry (R-Lincoln), spoke to a group of elected officials and Montcross Chamber board members in Belmont about the newly enacted Opportunity Zone program, which was expanded in the 2017 Republican Tax Cuts and Jobs Act.

In May, North Carolina’s 252 Opportunity Zones were designated by the State approved by the US Treasury. The new program is intended to attract development to low-income areas by re-investing unrealized capital gains into designated communities. These communities were selected through a combined approach of comparing census tracks with areas with a poverty rate of 20% or higher, or a median household income that is less than 80% of the surrounding area.

To qualify for the program, an investor must self-certify as a Qualified Opportunity Fund – click here for more information. Investments made by Opportunity Funds will receive temporary tax deferral for reinvested capital gains, step-up in basis for capital gains reinvested in an Opportunity Fund, and permanent exclusion from taxable income of long-term capital gains.

The program is still awaiting final implementation processes from the Treasury Department and IRS, but ability to apply for certification as a Qualified Opportunity Fund and therefore utilize this program is expected in late 2018 or early 2019. Charlotte Planning Department Launches Comprehensive Reorganization

The Charlotte Planning Department is undergoing a comprehensive reorganization, in an effort to streamline the development approval process and reduce the number of conflicts that arise between final rezoning and site plan review.

The initiative is moving forward even as Charlotte’s Unified Development Ordinance takes a step back, to allow staff to begin work on a Comprehensive Plan to guide the City’s growth over the next two decades.
